Is Salvia Divinorum Legal?

Yes and no.  Technically salvia divinorum is a herbal incense product that grows naturally in various parts of the world (mostly in Mexico).  However one of the active components of salvia divinorum, called Salvinorin-A, is a psychoactive substance, which is starting to become regonized as a controlled substance by various governments.

Because of the recent attention that salvia divinorum has recieved, some states within the US have schedule Salvinorin-A to be banned.  Currently only three states have done this: Delaware, Louisianna, and Missouri.  In addition, Australia has banned salvia divinorum (which is strange considering it grows naturally there!).

While there is a small movement to ban salvia divinorum in the united states, currently it is completely legal to buy and consume salvia divinorum in the remainder of the United States (and the rest of the world for that matter).

Be rest assured that unless you reside in one of the states listed above (or Australia), you are not breaking any laws if you buy or consume salvia divinorum.

What is Salvia Divinorum?

Salvia is a magical herb that grows naturally in Mexico.  For thousands of years it has been used by the native tribes for medicinal purposes, spiritual journeys, meditations, and rights of passage.  But lately this wonderful herb has been making appearances in North America as people have begun to realize the power of this majestic herb.

Salvia Divinorum produces hallucinogenic experiences when properly consumed.  It’s also reported to cause out-of-body experiences, encounters with aliens, euphoria, and many other pleasant symptoms. 

And better still, Salvia Divinorum is LEGAL.  A few states are trying to ban salvia divinorum (specifically the southern states).  Salvia is legal in the rest of the united states, and it’s even grown in a few states (even Hawaii has it’s own strain of salvia divinorum that grows there naturally now!).
